Theme Licence

1. Licence grant

Upon purchase, Yavi Themes grants you a non-exclusive, non-transferable, revocable licence to use the purchased product in accordance with the licence you have acquired.

Ownership of the software is not transferred.

2. What one licence covers

One licence covers one live website, identified by its domain.

Development, staging and test environments do not count against that: you may run up to three of them alongside the live site at no extra cost. Environments are recognised automatically from their host name — for example dev.example.com, staging.example.com or a local .ddev.site address.

If a registered live domain stops contacting our licence server for 30 days, the next activation releases it automatically, so a relaunch or a domain change needs no support request.

3. Permitted use

Within the scope above, you may:

• Install the product on the live website your licence covers, plus its development environments.
• Modify the source code to meet your project requirements.
• Customise layouts, styles, templates, and configuration.
• Use the product for personal, commercial, or client projects.
• Receive updates and support for as long as your update window is open.

4. Prohibited use

You may not:

• Redistribute the product or any part of it.
• Sell, sublicense, rent, lease, or transfer the product.
• Share download packages or licence keys with third parties.
• Publish the source code for public download.
• Remove or alter copyright notices where required.
• Circumvent licensing or security mechanisms.
• Claim the product as your own work.

5. Agency and client projects

Agencies and freelancers may use Yavi Themes to build websites for clients.

Each production website requires its own licence. Building a second client site means a second licence, so each project keeps its own updates and its own support.

Clients do not automatically receive ownership of the product or its source code.

6. Source code modifications

You are free to modify the source code for your own projects.

Modified versions remain subject to this Theme Licence and may not be redistributed or sold.

7. Updates

Each licence includes one year of updates from the date of purchase. Updates may include security fixes, bug fixes, performance improvements, TYPO3 compatibility updates, new features and documentation improvements.

When that window ends, the version you have installed keeps working without restriction. You simply stop receiving new builds until you renew. Renewal extends the window from its previous end date if the licence is still current, and from the renewal date if it has already lapsed.

8. Licence activation

An installed Yavi product contacts our licence server to verify that its key is valid and which updates it may receive. In doing so we record the domain of the installation, whether it is a live or a development environment, the time of activation and of the most recent check, and the IP address the request came from.

9. Support

Support is provided for issues directly related to Yavi Themes products, and generally includes:

• Installation assistance
• Configuration guidance
• Bug reports
• Compatibility questions
• Product-related issues

Support does not include:

• Custom development
• Website design
• Third-party extension support
• TYPO3 upgrades unrelated to Yavi Themes
• Server administration
• Training or consulting services

10. Third-party components

Our products build on and integrate third-party software released under separate licences, including the TYPO3 Bootstrap Package. Those components remain subject to their respective licence agreements.

Yavi Themes does not claim ownership of third-party software.

11. Intellectual property

All copyrights, trademarks, source code, documentation, graphics, icons, templates, and other intellectual property remain the exclusive property of Webagentur YAHYA unless otherwise stated.

Purchasing a licence grants usage rights only. No ownership is transferred.

12. Licence violations

Violation of this Theme Licence may result in:

• Suspension of support
• Suspension of update access
• Licence termination
• Legal action where applicable

13. Warranty disclaimer

All products are provided “as is” without warranties of any kind.

While we strive to maintain high quality, we do not guarantee uninterrupted operation or compatibility with every TYPO3 installation, extension, hosting environment, or custom implementation.

14. Limitation of liability

To the fullest extent permitted by law, Webagentur YAHYA shall not be liable for any indirect, incidental, consequential, or financial damages arising from the use or inability to use our products.

Our maximum liability shall not exceed the purchase price of the respective product.

15. Changes to this licence

Yavi Themes reserves the right to update this Theme Licence at any time. Updated versions become effective upon publication on our website, and apply to purchases made after that date.

16. Governing law

This Theme Licence shall be governed by the laws of Switzerland. Any disputes shall be subject to the jurisdiction of the competent courts in Switzerland, unless otherwise required by applicable law.
